Terms of Service

1. Acceptance of Terms

By accessing or using VillageDex ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

VillageDex is operated by Christmas Village Experts LLC, located at 5500 Sunrise Highway, Unit 50, #1090, Massapequa, NY 11758, United States. References to "VillageDex," "we," "us," and "our" in these terms refer to Christmas Village Experts LLC.

These Terms of Service also constitute the Terms of Use and End User License Agreement (EULA) for the VillageDex mobile applications distributed through the Apple App Store and Google Play Store.

2. Description of Service

VillageDex is a collector platform for Christmas village enthusiasts. The Service provides collection management, item identification, marketplace pricing, community showcases, and related features for Lemax, Department 56, and St. Nicholas Square collectibles.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use VillageDex.

One account per person. Automated account creation is prohibited.

4. Subscriptions and Billing

VillageDex offers a free tier and paid auto-renewing subscription tiers (VillageDex Collector and VillageDex Pro), each available as a 1-month or 1-year subscription.

Web purchases: Subscriptions purchased on villagedex.com are billed through Stripe. You may cancel at any time from your dashboard; your plan remains active until the end of the current billing period.

Mobile in-app purchases: Subscriptions purchased in the VillageDex iOS or Android app are billed to your Apple App Store or Google Play account. Payment is charged at confirmation of purchase, and the subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel these subscriptions at any time in your device's store account settings (on iOS: Settings → Apple ID → Subscriptions; on Android: Google Play → Payments & subscriptions). Deleting your VillageDex account does not automatically cancel an App Store or Google Play subscription — you must cancel it through the store.

Refunds for web purchases are handled on a case-by-case basis; refunds for App Store or Google Play purchases are governed by Apple's and Google's refund policies. Contact support@villagedex.com for billing inquiries.

We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. User Content

You retain ownership of content you upload (photos, showcase descriptions, comments). By uploading content, you grant VillageDex a non-exclusive, worldwide, royalty-free license to display, store, and distribute your content within the Service.

When you share photos to the catalog, they become available to all users of the platform.

You are responsible for ensuring you have the right to upload any content. Do not upload content that infringes on others' intellectual property.

6. Prohibited Conduct

  • Uploading illegal, abusive, or inappropriate content
  • Harassing or threatening other users
  • Attempting to access other users' accounts or data
  • Using automated tools to scrape or bulk-download data
  • Circumventing rate limits or security measures
  • Impersonating other users or VillageDex staff
  • Using the Service for any illegal purpose

Violation may result in account suspension or permanent ban.

7. Marketplace Pricing

VillageDex displays estimated market values based on publicly available data from eBay, Amazon, and other sources. These are estimates only and do not constitute appraisals or guarantees of value. VillageDex is not responsible for buying or selling decisions made based on these estimates.

8. Content Moderation

We reserve the right to remove content that violates these terms or community guidelines. Users can report inappropriate content using the report feature. We review reports and take action as appropriate.

9. Intellectual Property

The VillageDex name, logo, and original content are the property of Christmas Village Experts LLC. Product names (Lemax, Department 56, St. Nicholas Square) are trademarks of their respective owners and are used for identification purposes only.

10. Limitation of Liability

VillageDex is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

You may delete your account at any time — in the mobile app under Profile → Delete Account, or from your web account settings. Account deletion is permanent and removes your account and associated data as described in our Privacy Policy. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be handled according to our Privacy Policy.

12. Apple App Store Additional Terms

If you downloaded the VillageDex app from the Apple App Store, the following additional terms apply:

  • These terms are an agreement between you and VillageDex only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
  • Your license to use the app is limited to a non-transferable license to use it on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to furnish any maintenance or support services for the app.
  • In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation.
  • In the event of a third-party claim that the app or your use of it infringes intellectual property rights, VillageDex — not Apple — is responsible for the investigation, defense, settlement, and discharge of such claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes will be resolved through binding arbitration in New York, except where prohibited by law.
